How to Repair Windows in a New York City Condo

As of July 2010, a growing percentage of New York City apartments have been converted into condominiums and co-ops. While co-ops are governed by a board and bought as shares in the corporation that is the building itself, condos do not require board approval and provide property ownership. Each condo has its own set of rules as laid out in the purchase agreement. If your condo requires window repair, the work begins with your contract itself.

      Determine whether the damage to your windows is your responsibility or that of management. According to William T. Walsh of the coop & condo monthly "The Cooperator," windows are typically the responsibility of condominium building management and are viewed as community property. If damage comes as a result of age or malfunction, the repairs are likely the responsibility of the building. If the damage is due to an action that's accidental or purposeful by the tenant, the repairs likely will be the tenant's responsibility.

      Contact the unit owner if you're a renter. According to The New York City Housing Authority, the landlord is liable for the upkeep and repair of all public areas and ventilation for the apartment. This only includes normal maintenance and not any damages caused by the tenant. If damages to the windows are caused by the tenant or the tenant's actions, the responsibility for repair lies with the tenant.

      Check your condo purchase or rental agreement, condo declaration, and the condo bylaws for your building. Each New York City condominium has its own unique contract that lays out the specifics of the agreement between tenant/owner and building management. It also has a set of laws that govern tenant conduct and responsibilities. Refer to the repairs and maintenance clauses in your agreement, bylaws and declaration documents to determine where the responsibility for window repair lies.

      Contact a local, licensed contractor to perform the window repairs in your New York City condominium. Each building will have a list of preferred contractors whose work meets the standards of the building. While you aren't typically obligated to use a contractor from this list, these contractors usually know the building inside and out and will come prepared for the work that needs to be done. In certain instances, the building bylaws may require the use of a particular contractor or company for repairs.

      Schedule any repairs on the days allowed by building management or bylaws. Certain condos will have specific schedules for work that aim for preserving a quiet environment and avoiding tenant/owner complaints. Check the hourly restrictions as well. Work must be done between certain times to avoid being a hindrance to building occupants.
